1. The right to access and use the Clan

1.1 Subject to the terms and limitations of this Clan Policy, upon completion of the registration process on the Platform as described herein, you are granted a limited, revocable, non — exclusive and non — transferable right-as the Clan Owner-to access and use the Platform solely for the purpose of organizing one or more clans on the Platform. Use of the Platform is subject to applicable fees and other charges specified in Section 7.

1.2 For the avoidance of doubt, you are not granted any other licenses in relation to the Platform or in any other way other than those expressly stated in this document.

 

2. Who can create a clan and participate in it?

3. What is a clan and what can members do in clans?

3.1 Clans are tournament organizers and it is not possible to organize a tournament without a clan

4. Creating and hosting a clan

4.1 The specific purpose defined by the Clan owner for the clan, and the set of rules provided by the Clan Owner for this purpose, must always comply with the general Cybfed policies and Terms of Use, as well as applicable laws and regulations. In the event of a conflict between the purpose and rules provided by the Clan Owner and the Cybfed rules, the latter will always take precedence between Cybfed and the Clan Owner, as well as in relation to any Users, Organizers, Participants, Service Providers or other organizations using the Platform. Cybfed may, in its sole discretion, warn, reprimand, or intervene to take control of a Clan when it discovers rules or behavior contrary to any Cybfed policy and/or terms and conditions and believes it is in the best interests of the Clan or the Platform as a whole to do so.

4.2 The Clan Owner may appoint one or more of its Members as administrators and judges.

4.3 The clan owner is responsible for ensuring compliance with the established rules for the clan. If the Clan Owner or Clan Administrator discovers that any Member violates the Clan's specific rules or any Cybfed terms or policies, the Clan Owner may - for good reason-decide to terminate the Members ' access to the clan. (including the termination of access to any Services and Services for members in such a clan). In addition, any active Subscriptions to the specified clan can be terminated. Banned members will not receive a refund unless the Clan Owners deem it appropriate in their sole discretion.

4.4 A member who is blocked from the clan cannot join the clan again. If Cybfed discovers that a Member has been blocked from multiple clans due to misconduct or violation of applicable policies, rules and regulations, Cybfed may, but is not obligated to, block the User's Account on the Platform as a whole.

4.5 Clan Owners are free to post a Clan on any subject, game, community, or topic they wish, as long as it complies with this policy, other Cybfed terms and policies that may apply, and applicable laws and regulations. However, the following types of behavior, content, or offers should always be considered a violation of this policy, which may result in blocking.:

  • Services and services for Participants that are intended to mislead or defraud Participants.
  • Clans that are mostly used or filled with spam.
  • Gambling, lotteries, or sweepstakes.
  • Pornography or sexually explicit content.
  • Services and services for participants in personal or sexual relationships.
  • Content that threatens children's safety.
  • Harassment or cyberbullying and defamation.
  • Other harmful or dangerous content.

 

5. Monetization of clans

5.1 The Clan Owner decides whether access to the clan is free or whether the Member is required to pay for membership. In addition, in a clan, the Clan Owner can choose to offer both free and paid Services to its Members. Each Clan Owner decides for himself what specific amount and what Services will be included in the paid membership.

5.2 Monetization options available to the Clan owner:

  • "Subscriptions": Charge a monthly regular subscription for a Clan membership. Clan owners can grant subscribers additional privileges and benefits, but are not required to do so.
  • "One-time Fees": Charge a one-time fee for membership and/or Services provided in the Clan. Clan owners may grant additional privileges and benefits to these members, but are not required to.
  • "Entry Fees for participating in competitions ": There may be an entry fee for participating in competitions organized in a clan, which members must pay in order to participate.

 

6. Monetization requirements

6.1 To enable monetization and start earning money in the Clan, the Clan Owner must meet and accept the following requirements::

  • If you are an individual, you must be at least eighteen (18) years old.
  • Please provide your full residential address, including your official name and country.
  • Enter the verified phone number.
  • Please provide valid payment details, such as your PayPal account, or other alternative payment methods currently offered through the Platform.
  • Cybfed will issue Cybfed invoices on your behalf for the services (as defined below) that you sell, so-called self-invoicing.

6.2 Cybfed may revoke the Clan's monetization privileges at any time if the Clan Owner confiscates it to meet the requirements listed above, or otherwise violates this Clan Policy. Any profits accrued at that time can be revoked by the Clan Owner, provided that such profits were not obtained illegally or in violation of the basic policy.

 

7. Fees and earnings

7.1 In exchange for providing the Platform in accordance with the general Policy, Cybfed is entitled to a platform commission of thirty percent (15%) of all income (excluding VAT) from paid Subscriptions, One-time fees or Participation Fees received from your participants. The platform fee will be automatically deducted when purchasing Members from the clan.

7.2 The clan owner's income from his clan is visible on the clan settings page. Clan owners can receive a monthly summary of invoices for all transactions made during the last month, or otherwise upon request (which should not be excessive or unreasonable) for their own income, taxation, and other reporting purposes.

7.3 The Clan Owner is solely responsible for declaring any VAT, VAT equivalent or income tax in accordance with the requirements of relevant national, provincial, state and local laws and regulations.

 

8. Taxes and VAT

8.1 General services

8.2 All services are considered electronic services under the US VAT rules.

8.3 Consequently, Cybfed is required to account for outgoing VAT when selling clan services to end users. The applicable VAT rate depends on where the end user is located.

8.4 Clan services in terms of VAT are sold through Cybfed to the end user, i.e. after the transaction is completed, Cybfed buys the corresponding service from the clan owner or participant and immediately sells it to the end user.

8.5 The Clan Owner and member are solely responsible for declaring any VAT, VAT equivalent or income tax in accordance with the requirements of their respective national, provincial, state and local laws and regulations.

9. Clan subscription

9.1 The User can either join a clan and become a Participant, or join a contest organized by the clan from anywhere on the Platform and automatically become a Member of the clan organizer.

9.2 Clan members can interact with each other in various ways, and depending on how the Clan Owner has set up the clan, Members in the clan can create and participate in various Services for each other. For the sake of clarity, Cybfed's Terms of Use and other applicable policies apply to Participants ' use of the Platform, including their use of the clan.

9.3 A member may leave the clan at any time. You can log out of the clan via the clan interface. Paid members, such as members who have a clan subscription, can also view and change all their current subscriptions in their account settings.

 

10. Advantages of a clan subscription

10.1 Clan Owners may, at their own expense, offer paid Members access to certain benefits that are available only to such paid Members, providing them with any tangible or intangible advantage, bonus or value ("Benefits").

10.2 Clan Owners who offer an Advantage to their Members must grant such Privileges to their eligible Members in a timely and reliable manner. Benefits are determined by the Clan Owner, and Cybfed does not have any means to ensure that such Benefits are provided to Members as specified.

10.3 Benefits may include, but are not limited to, special tournaments, competitions, live broadcasts, prizes, AMAs (Ask-me-anything), specific content such as images or videos, special icons, emoticons, skins, or other digital elements.

10.4 Relationship between Clan owners and Cybfed. Cybfed is not an organizer or provider of Services or Services for participants, events or contests available in any of the clans on the Platform, unless expressly stated otherwise. Cybfed is more of an intermediary for the service provider. As such, Members who benefit from any Member Services or Services, or participate in other clan activities, enter into agreements created or arranged by those Clan Owners or Service Providers.

10.5 When participants pay for services or services for participants, they enter into transactions with individuals or entities that offer these services (unless otherwise specified), and not with Cybfed.

 

11. Malfunctions, Fraud, Unauthorized access and suspension or termination of clans

11.1 The platform is cloud-based and available over the Internet, so its actual availability depends on factors partially independent of Cybfed. You agree, without limitation, that Cybfed is not responsible for technical, hardware or software failures, lost or unavailable network connections, disconnections from competitions, matches or other services provided through the Platform, or any incorrect or inaccurate results that may be published on or in connection with such competition. a match or other service. You also agree that Cybfed will not be liable for any damage, loss, or injury resulting from hacking, tampering, or other unauthorized access to or use of the Platform or Services.

11.2 You can't:

  1. use, copy, or otherwise transmit the Platform or parts of it, except as expressly permitted by this Clan Policy. Under no circumstances may the Clan Owner change, develop or make additions to the Platform himself or with the permission of any third party;
  2. sublicense, rent, loan, or otherwise authorize any third party, directly or indirectly, for or without remuneration, to dispose of or otherwise use the Platform, unless otherwise expressly stated herein;
  3. decompile, disassemble, or reconstruct the Platform, or otherwise attempt to recreate the source code of the Platform or make copies for archiving or disaster recovery purposes, except as expressly permitted by mandatory legislation
  4. remove or modify proprietary notices on the Platform or in the media through which it is accessible, with respect to patents, copyrights, trademarks, or other intellectual property.;
  5. access or use the Platform in such a way as to avoid any applicable fees or exceed any usage restrictions;
  6. access or use the Platform for any purpose other than that specified in this space policy; or
  7. access or use the Platform for fraudulent or illegal activities or activities that violate Cybfed's policies or otherwise cause harm to us or any third parties.

11.3 Cybfed reserves the right, in its sole discretion, to suspend or terminate any Clan and Clan Owner found guilty of violating any of the provisions set out in Section 11.2 above or otherwise violating this Clan Policy.

 

12. Responsibilities of Clan owners and organizers

12.1 If a clan has a specific purpose or set of activities, Privileges, or Services offered to its Members, the Clan Owner must fulfill these promises and provide the activities and Services in a reliable and timely manner. Cybfed will not actively enforce non-compliance with this requirement, but may, at our discretion, revoke the Clan Owner's control over a clan that does not comply with the rules and regulations established either by the clan or by us at Cybfed as a whole.

12.2 The clan owner is obliged to provide constant support and administration of competitions for their Participants. Cybfed does not administer, manage or support competitions organized in clans, unless otherwise stated.

12.3 If a Clan Owner grossly mismanages a clan or abandons a clan that is reasonably important to the Platform community, Cybfed may seize control of the clan for the benefit of the specified community and the Platform as a whole.

 

13. Content of the clan

13.1 The Clan Owner grants Cybfed and its affiliates, partners and distributors a non-exclusive, worldwide, royalty-free, perpetual, fully sublicensed license to use, distribute, edit, display, archive, publish, sublicense, perform, reproduce. , provide, transmit, broadcast, sell, translate, and create derivative works based on the clan's content.

13.2 You represent and warrant that you have all the rights necessary to grant Cybfed and its affiliates the license set out in Section 13.1 above, and that such content is not defamatory or infringes any third-party rights, including, but not limited to, any intellectual property rights or applicable rights. laws.
